From the early 90 s of the last century to the present,fan culture has developed into a cultural phenomenon that cannot be ignored in today's society.The rapid rise of fan fiction has also brought a lot of copyright issues.However,at present,the theoretical research on the work of colleagues in China is still insufficient.The copyright law and other laws also lack explicit regulations on the fan fiction.Because of the works created by the fan fiction in the original work elements,it will inevitably lead to the existence of a natural right conflict between the fan fiction and the original works.At the same time,because of its own dependence on the original work,originality,and the form of rights conflict with the original work,it cannot be simply included in the interpretation of the work.In addition,his works are original and belong to a form of “work”.They are also works created by the public on the basis of freedom of expression.They conform to the legislative purpose of copyright law,have their legitimacy,and should expand the scope of works.Fan fiction works are included in the protection scope of the Copyright Law,and the relevant contents are confirmed and regulated so as to balance the interests between the author's author and the original copyright holder.
