Research On The Legal Supervision Of Shared Bicycles

With the continuous development of Internet technology and economy in China,in recent years,sharing bicycle as a new mode of development in the sharing economy has attracted special attention.Sharing bicycle has solved the problem of "the last kilometer" of the city.And has the advantages of flexible and convenient use,energy saving and environmental protection.but because of the weakness of the traditional supervision mode to the new economic model,there are many problems in the field of sharing bicycles,and the absence of shared bicycle supervision,to a certain extent,has caused confusion in the industry.Also not conducive to the protection of the legitimate rights and interests of users.Sharing bicycle market itself has inherent defects and many safety risks,which is the legitimate source of shared bicycle legal supervision,but under the guidance of the concept of governing the country according to law.the supervision of shared bicycle essentially belongs to legal control rather than power control.Although the regulation of shared bicycle should be regulated by regulations and normative documents with administrative legal attributes,the object of legal regulation of shared bicycle is the interest relationship of market structure.Any content of shared bicycle supervision must be guided by the rule of law,and the regulatory measures of the government must conform to the premise and need of legal supervision of shared cycling.From the perspective of law and economics,this paper defines the conceptual characteristics of shared bicycle and the connotation and scope of legal supervision in the first part.The second part combines the relevant economic theory of legal supervision of shared bicycle on the basis of the first part.The necessity of legal supervision of shared bicycle is analyzed in depth,and the conclusion is drawn that if shared bicycle wants to develop healthily and orderly and benefit people's livelihood,it must be under effective legal supervision.The third part introduces the advanced experience of developing public bicycle abroad.Although there are differences between public bicycle and shared bicycle outside China,its development concept and specific supervision measures still regulate the law of sharing bicycle in our country.The fourth part,through the analysis and development of shared bicycle and its current situation of legal supervision,discusses some problems existing in the legal supervision of shared bicycle in China.The fifth part combines the relevant theories of sharing bicycle legal supervision on the basis of,Aiming at the specific problemsexisting in the current legal supervision process of shared bicycle,the author puts forward some suggestions to perfect the legal supervision system of shared bicycle.
