| Today,many business enterprises use its broad Internet platform launched the "Internet + consumer credit" financial products,such as "ants spend bai" and "the jingdong ious",etc.,and credit business development cannot leave the credit activity,the electricity business agency arises at the historic moment.It is the activity of collecting,processing and utilizing personal information,so the problem of personal information protection is the core issue that runs through the legal issues of personal credit investigation.How to balance the development of e-commerce and personal information protection is the key link in the protection of personal information in e-business credit.Due to the particularity of the e-commerce environment,the protection of personal information is more complicated than that of traditional credit investigation.This article from the electronic business operators in the collection and use of personal information,combined with the characteristics of credit information and electrical business credit bureaus of the mode of operation,summarizes the particularity of personal information protection in electric business credit.This paper starts from the existing problems in the protection of personal information by the e-commerce credit agency,and analyzes the lack of personal information protection in sesame credit.Through the analysis of personal information protection problems in the electricity business credit,the author thinks that the cause of the personal information protection issues in the electricity business credit in our country electric commercial credit reporting industry regulation and lack of personal information protection legislation.Specific performance is,one country to each industry personal information protection law enforcement supervision efficiency is insufficient,the long management phenomenon is widespread;The personal information protection industry standard is not uniform in the personal credit investigation industry,and the industry self-discipline function is not perfect.Second,the lag of the legislation process of personal information protection in our country seriously influences the formation of our personal information protection mechanism.In terms of personal information relief,due to the particularity of the personal information infringement,different with other common infringement behavior,the current civil procedural law in China against infringement of rights of information subjects.On the analysis of theelectricity business credit in the personal information protection legal issues,this paper pointed to the United States and European Union legislation on personal information protection measures on the outside and get some enlightenments.At the end of this paper,some Suggestions are put forward according to the legal analysis of personal information protection in China's e-commerce credit investigation and the investigation of extraterritorial legislation.First of all,starting from the concept of personal information protection,to two or morethings enterprise development with the protection of personal information,not simply rely on legislation to protect,encourage the development of the personal information protection technology,improve the efficiency of personal information protection.In the aspect of supervision of e-commerce credit investigation,this paper proposes to optimize the supervision mode of e-commerce credit investigation,introduce advanced Internet enterprise management philosophy,and improve the self-discipline mechanism of e-commerce credit investigation.In terms of personal information protection legislation,this article emphasizes the change before criminal law,administrative protection and the situation of lack of civil law protection of lay particular stress on,advocates strengthening civil legislation and civil relief system of the infringement of personal information,to ensure that the personal information protection laws,improve the efficiency of relief for infringement of personal information. |
