Campus outch to be a pleasant place to provide students with a safe and comfortable campus environment,but sexual assault occurs frequently in campus.Recently,the campus sexual assault caused public’s attention.Peoples begin to pay attention to the safety of children at school.Campus sexual assault has became a major threat to campus order and student safety.Numburous victims,long duration and great harm is the major chararistics of campus assault.In addition,in the "master-type" campus sexual assault,due to the special campus environment and the relationship between the parties,the incidence of this type of sexual assault has remained high.Because of sexual predilection among children and the induction of sexual impulses,the incidence of sexual assault by classmates is gradually increasing.Although in recent years,China begains to pay more attention on campus sexual assault and has formulated and amended a series of legislations to protect children’s sexual rights.For example,the Criminal Law Amendment(9)extends the object of obscenity to men.In the "General principle of civil law",the right to claim damages for minor sexual abuses shall be extended to the date on which the victim turns 18 years of age.In 2018,the Standing Committee of the National People’s Congress proposed to amend the School Bullying Act as well as the Law on the Protection of Minors and the Law on prevention of minors delinquency.The formulation and improvement of the above mentioned legislations embodies the rising concern of our country for children’s sexual assault and the increase in the protection of children’s sexual rights.However,the sexual assault still at a high rate.In order to prevent the occurrence of child sexual assault and strength the protection of children’s sexual rights.This article can be divided into the following three aspects: The first part liberating the concept of campus,children,and sexual assault.First of all,the term “campus” is defined as the campus where the case occurred.It has nothing to do with the identity of the injurer,but the victim should be a student at school.Second,the definition of children is students who under eighteen years old.The definition of ages conforms the "International Convention on the Rights of the Child",which is the first convention to protect the child’s rights.Finally,the definition of sexual assault is defined as “non-contact” which means the child sexual assault includes not only touching,body cavity insertion and other contactbehaviors,in order to establish a minimum standard to protect children’s sexual rights,in this article,tempt children to watch pornography and related behaviour shall be deemed as sex inclusive.In the second part,according to the different personnal identities of the children’s sexual assault on campus,the child sexual assault been divided into three different types which includes the teacher-source campus sexual,the campus sexual assault of classmates,and the sexual assault students by others.Because most of the sex assault caused by staffs inside and outside the school,such as off-campus personnel enter the school for student sexual assault and non-teaching staff(security guards,cooks)assault on students,can be admttributable to the weak governance of campus security and the lacking of self-protection sense of students.Therefore,the third type of campus sexual assault shall not be extended in this article.This article shall focus on the study of the first two types of campus sex assualt,reason the occurance of different types of campus assualt from the different types of victim,legislation,school and society.The third part of this paper identified the current laws and regulations in China.,and provide some suggestions on the protection and improvment of campus children’s rights by studying the relevant legislations and legal practises of foreign countries.
