Research On The Damage Compensation Standard Of Environmental Civil Public Interest Litigation In China

In recent years,with the rapid economic development in our country,the problem of environmental pollution in our country is also becoming increasingly serious.Environmental public interest litigation cases are also more and more.However,at present,our country's legislative provisions on the related issues of compensation standards in environmental public interest litigation are not perfect.This has an unfavorable influence on the safeguarding of citizens' legitimate rights and interests and social stability.Therefore,it is necessary to study the relevant compensation standards in environmental public interest litigation so as to make the related procedures more perfect.With the state's emphasis on environmental public interest litigation,China's environmental public interest litigation process is also gradually improved,the relevant legislation also provides some specific provisions on environmental public interest litigation,which provides a theory for determining the compensation standard for damages in environmental public interest litigation Foundation.Based on the basic concepts,this article draws the current problems in our country through the typical case and the relevant trial practice of the court,draws inspiration from relevant foreign countries' practical experience and gives relevant suggestions.As for the research on the compensation standard of environmental public interest litigation,this environmental damage compensation standard involves many aspects,including the interests of environmental damage including public interest,private interest,how to define the benefit of environmental damage(public interest,private interest)in practice,Environmental liability insurance system,a special forensic institutions and many other elements and links.
