It is necessary and inevitable for our security companies to go out of the country to protect overseas Chinese enterprises.In order to meet the increasingly complex and harsh requirements of offshore security missions,it is necessary for our security companies to actively explore and practice the overseas armed security business so as to become an international security company in a complete sense.However,the conduct of armed security operations abroad is not only an ordinary commercial activity,but also a complicated legal practice involving the law of the home country of the security company,the law of the country in which the business is carried out and the relevant international law.So clear these three legal relations,to ensure that the business acts in accordance with the provisions of the law is to carry out foreign force Install premises for security operations.These are the three legal problems that our security companies are facing when they carry out overseas armed security business.The three major legal issues can be manifested as follows: first,there is a lack of norms in the domestic security industry law for armed security operations abroad and the conflict between the current law and the long-term development trend of security companies.The lack of legal norms seriously hindered our security companies from going abroad.And the current law also severely restricts our country's security companies to obtain business required guns.The second is that international law has not yet formed a clear and effective legal normative system on the rights and obligations of international security companies and the conduct of armed security operations.This business has become a grey part of international law,which seriously affects the rights and obligations of our security companies when conducting armed security operations abroad.The third problem is that China's security companies need to strictly abide by the relevant laws of the countries in which the operations are conducted when conducting armed security operations abroad,and the current legal provisions for armed security operations vary from country to country.To this need concrete problem concrete analysis more.In view of the existence ofthe above three legal problems,the main task of this paper is to analyze and discuss these three legal problems,and to put forward the corresponding solutions,that is,to perfect the legislation of the security industry and amend it first.The relevant laws can promote the business transformation of domestic security companies and vigorously support domestic security companies to go out of the country to carry out foreign armed security services.The second is to provide guidance to the specific foreign armed security business of our security companies by fully studying and interpreting relevant international laws;and in addition to armed security.The legislation of the developed countries is analyzed and studied to provide useful reference for the formulation of relevant foreign security legal documents in China.Finally,the successful experience and methods of applying the law of different countries and different security laws can be found out from the experience of the successful expansion of international security market by some international security companies.National security companies successfully open the armed security services market in other countries to provide reference and legal advice.After a thorough analysis and study of these legal issues and corresponding legal proposals to resolve them,This paper hopes to provide a legal aid for the domestic security company to transform into an international security company and to carry out the overseas armed security business successfully.
