The Lack And Improvement Of The Custody System For Children In Distress

Children are the future of a country,and they are also vulnerable groups that are recognized by all countries in the word.It is easy for them to become troubled by various reasons and become children with difficulties.In protecting the rights and interests of these children,the most important thing is to protect their guardianship rights and interests,so that they can grow up in a good guardianship environment,which requires a complete guardianship system about children in difficult situation.As an important part of the guardianship system,the guardianship system for children in difficult situations should focus on the issues of lack of guardianship and improper guardianship.However,in this regard,our country still has deficiencies.The concert manifestations are the lake of legislation on child custody in difficult situations,the weak monitoring network,inadequate construction of guardianship mechanism.After examining the current status of legislation about children's custody in our country,this paper puts forward some suggestions on perfecting the system,that is,a more mature legislative system should constructed to refine the legal norms of custody for special children,strengthen social guardianship and state custody,establish a early-warning mechanism and improve the supervision mechanism of guardianship.It is hoped that these studies will help improve the guardianship system for children in difficult situations in China.
