Research On The Legal Issues Of Rural Collective Assets Shareholding System Reform

Along with the rural industrialization,informatization,urbanization and agricultural modernization gradually realize,the reform of rural collective property rights system needs urgent,the establishment of "attribution is clear responsibilities,strict protection and smooth circulation of the modern property rights system is the inherent requirement to promote the development of rural collective economy activity.The party was put forward in the third Plenary Session of the 18 th CPC Central Committee to improve the rural property rights protection system,giving farmers more property rights,the protection of the rights of members of the rural collective economic organizations,the positive development of farmer cooperative shares,to enable farmers to enjoy the rights of possession,income,paid exit and guarantee,mortgage,inheritance and other collective assets shares,according to the requirements of the policy file combined with the practice of reform,rural collective property rights system of rural collective assets stock system reform is a major innovation model of rural collective property rights system reform.In this paper the author participates in the high tech Zone of Zibo City,two villages(neighborhood)implementation of the collective assets of the joint-stock reform,based on the new situation of the rural collective assets of the shareholding system reform and the deepening of practice form of rural economy shares,explore the collective assets of the joint-stock reform program,the reform of collective economic organizations.Discuss the provisions to improve laws and policies,so as to improve the operation mode of collective economic organization and supervision measures,to provide a practical basis for the full implementation of the joint-stock reform of rural collective assets.This article is divided into four parts.The first chapter introduces the related concepts of rural collective assets in joint-stock reform;collective assets relates to the joint-stock reform of rural collective assets,rural collective property rights system,the rural collective economic organizations,joint-stock concept,according to the provisions of existing laws and regulations and policies,as well as the definition of its meaning,in order to accurately grasp the connotation of collective assets stock system reform.The second chapter discusses the rural collective economic organizations at this stage of the restructuring of the corporate form of organization,and to choose the form;analyzed the advantages and disadvantages of rural collective assets in joint-stock reform of collective economic organization reform,restructuring of the collective economic organization hassignificance in the choice of the form of restructuring,the restructuring of the collective economic organization according to the actual situation the judgement of restructuring the quality,make accurate judgment and choice of its restructuring in the form of.In the third chapter,the practice of rural collective assets in Zibo high tech Zone of the joint-stock reform as an example,from the angle of practice shows the rural collective assets of the joint-stock reform program,and the specific steps in the reform process,and analyzes the legal issues involved;the fourth chapter expounds the shortcomings of the existing legal system of rural collective the assets in the stock system reform of the law,from the policy level to improve the rural collective assets of the shareholding system reform proposals.
