Property-style hotel as a fusion of the real estate industry and the hotel industry's new investment model,conform to the trend of tourism real estate.As early as,1990 s,with the concept of “time-share hotels” from Europe and the other developed countries into China,after the evolution of the development,The first domestic property-style hotel was born in Hainan,and then developed in the other cities.It is undeniable that not only the “global tourism”suggested in two sessions but also the actual development of the tourism industry,both in the southwest or the southeast coastal areas,the real estate investment model is worthy of our attention.Property-style hotel is characterized by the separation of property rights and management rights.Investors commissioned or leased rooms to specialized hotel management company for unified managements,enjoy two special rights different from customers who participate in other hotel projects: annual free entry and access to the hotel's operating income.This article talks about the interests of investors mainly based on the relationship between investors and hotel management companies.This paper analyzes the validity of the contract as the basis of the investor's interest protection,and clarifies the rights and obligations of the investors in the property right management,analyzes the operation and management of the investors in the case of the purely theoretical reasoning,from the point of view in the dispute of the case to the two major issues in protecting interests,from the point to the surface,,and its recommendations.This article divided into three parts to analyse the idea:The first part introduces the three cases associated,including the case begins,the case goes through and the results and the main focus of the case to guide the overview for the following legal basis analysis.The second part is the embodiment of the focused problem of legal analysis,is an important part of this article.First of all,there is a basic overview of property-style hotels,including its definition,the relevant concept of differentiation,the overall mode of operation and management of the two models,stakeholders and investor rights and obligation and so on.To clarify the legal relationship between the various stakeholders,especially the hotel managementcompany and the legal relationship between investors,help to clarify the scope of the discussion;point out that the business process as a basis for the protection of the rights and interests of the rules,clear their legal issues in the course of their business.The third part is the conclusion and revelation of the case.Mainly for investors' earnings and regulatory issues related to the feasibility of the proposal is on the legal analysis of the proposed solution and analysis of the case after the extension of thinking.
