Legal Issues And Countermeasures For The Disposal Of Bad Assets In Commercial Banks

With the all-around opening up of our financial industry,our financial market is increasingly integrated into the global economic and financial system,and such foreign financial institutions as foreign banks constantly flow into the domestic financial market,so our commercial banks are faced with unprecedented challenges and competition.To make themselves more competitive,our commercial banks deal with and solve a great number of non-performing assets,and finally achieve a lot.However,these assets cannot be dealt with once for all,new ones still exist.Although our country has passed some laws,administrative regulations and rules related to non-performing assets,there are still some flaws in the legal system that deals with these assets.Often in the specific process,there is no legal basis because of the lack of relevant laws or rules.This article analyzes the status quo and causes of the non-performing assets in our commercial banks,studies some legal problems when dealing with these assets,and proposes some solutions that prevent and solve these assets:strengthening the asset safety based on the domestic condition and foreign advanced experience,dealing with non-performing assets legally.With the effort from all sides,the reform of our commercial banks can be promoted and enhanced to eliminate financial risks.
