The Study Of Industry-university-research Intellectual Property Rights Conflict And Coordination Mechanism

Since April 2010,President Hu Jintao made speech on the one hundredth anniversary of Tsinghua University,industry-university-research collaborative innovation has caused the wide attention of the society.Collaborative innovation driven strategy was put forward in the Eighteenth National Congress of Communist Party in December 2012,which pushed industry-university-research collaborative innovation become a new fashion style of innovation.The essential of industry-university-research collaborative innovation is the application and acquiring of intellectual property rights,of which the intellectual property rights conflict is inevitable.Industry-university-research collaborative innovation intellectual property rights conflict would bring about unnecessary loss and trouble to every participate,influence the smooth implementation of the collaborative innovation,even lead to the midway disintegration of the collaborative innovation system.Comprehensively studying the formation mechanism,conflict degree measurement and coordination mechanism that can rich industry-university-research collaborative innovation theory,provide strong support for the smooth implementation of the industry-university-research collaborative innovation.According to the related literature,this paper analyzes the formation mechanism of industry-university-research collaborative innovation intellectual property rights conflict,applies the Fuzzy Comprehensive Evaluation Method to measure the industry-university-research collaborative innovation and intellectual property rights conflict degree,and building the coordination mechanism of industry-university-research collaborative innovation intellectual property rights conflict.This paper mainly includes four parts.In the first part,on the basis of analyzing the related literature,this part deepens the understanding of industry-university-research collaborative innovation,summarizes the connotation of industry-university-research collaborative innovation intellectual property rights conflict,understands the interaction of industry-university-research collaborative innovation and intellectual property rights,and lists the manifestation of intellectualproperty rights conflict in every stage.In the second part,on the basis of understanding of the related literature about industry-university-research collaborative innovation ntellectual property rights conflict,this part analyzes the formation mechanism of ndustry-university-research collaborative innovation ntellectual property rights conflict from four aspects.They are interest conflicts among different collaborative innovation subjects,the conflicts between collaborative innovation overall aim and collaborative innovation subjects individual aims,unsound relevant policy,and unperfect third party.Besides.this part applies evolutionary game theory to establish industry-university-research collaborative innovation intellectual property rights conflict forming mechanism model,to.futher detailedly the interest conflicts among different collaborative innovation subjects.From the game system we get evolutionary stable strategies,and analyze the influence factors of evolutionary stable strategies.In the third part,According to the expression form of property rights conflict in contact period,operating period and innovation production distribution period,this part determines the first grade indicators and the second grade indicators,uses the Analytic Hierarchy Process(AHP)to calculate the weight of every grade indicators,and uses the Fuzzy Comprehensive Evaluation Method to measure the industry-university-research collaborative innovation intellectual property rights conflict degree.Besides,application example is given.In the fourth part,on account of the formation mechanism of industry-university-research collaborative innovation intellectual property rights conflict,this part builds several coordination mechanism.They are interest conflicts coordination mechanism,overall aim and individual aim coordination mechanism,policy coordination mechanism and the third party coordination
