Legal Studies On Developing Xisha Island Tourist Resources

After the establish of the city of Sansha in June 2012,many tourists are attracted by the Sansha island.Among those islands,the islands of Xisha is the most welcome island by it’s safety and mature travel condition.And all that makes Xisha a dream to many persons.Nowadays,the travel methods in the islands of Xisha mainly conclude the cruise tourism and the private sea fishing.Only the cruise tourism could be the official,and the much more appearance of the private sea fishing actually is the contradiction of the lowly development and strong desire in travel.And also,some problems like the safety of tourists,the protection of ecosystem and the supervise of government exist in the two travel methods.Because of the imperfect of the development of the resources and the law,there still some problems exists in and need to be solved.Our country has been established some laws to the protection and development of islands.Xisha island,as the island of our country,should apply to the same law.It mainly conclude,the Island Protection Law of the People’s Republic of China,the tourism law of the People’s Republic of China and so on.These laws,to some extent,provide the protection of the development of the resources of Xisha island,but it’s too decentralization,and because there are no specific law according to the Xisha island,there are problems to be solved.Concreting speaking,these problems can be translated into following parts.First,the subject of management and development is not sure.Second,the government is not certain in the duty of the market.Third,the law protection of the ecosystem is not perfect.Four,the power of local government is limited.Five,the shortcoming of judicial protection system.
