State-owned natural resource assets regulatory agency is purported to be established on the principle of“owner and regulator separated”and“one department in charge of one thing”,with a view to solving problems concerning owners of state-owned natural resource assets.Though there is no clear and definite statement about the name and organizational form of such agency,it has already been blueprinted with express intention and purposes.At present,the management of state-owned natural resource assets involves so many departments with the feature of proper horizontal separation and vertical coherence,nonetheless,there is no direct provision on the state-owned natural resource assets and function deployment of the regulatory agency in existing laws and regulations.However,it is the fact that the existing regulatory departments fail to strictly distinguish the functions of owners from those of regulators that causes conflicts in functions and therefore gives rise to the function deployment problems in existing regulatory departments.Function deployment problems are usually resulted from the limitations of relevant theoretical researches and the inefficiency of existing management system.The existing regulatory departments ' excessive attention to the economic value of state-owned natural resource assets,ignorance of the ecological value thereof,and rough use of such have caused losses to the stat-owned natural resource assets,which is partly due to the unclear understanding of the nature of natural resources.In addition,differences in cognition of state-owned natural resource assets also limit the scope of functions of the existing regulatory departments,which makes the overall management unachievable.Besides,the imperfect existing state-owned natural resource assets regulation mode directly causes conflicts between the functions of owners and regulatory functions.It is undoubtedly that the problems generated during the existing regulatory departments' exercise of functions shall be the focus in regulatory function deployment,in addition to which,there are also many other factors that shall be taken into account in function deployment of regulatory agency.The state-owned natural resource assets may,in accordance with its economic and ecological attributes,be divided into operational resource assets and public benefit resource assets,and corresponding objectives shall be set to harvest better management.Moreover,the management scope of the regulatory agency shall be clearly specified and the separate relation thereof with natural and ecological regulatory agency shall be clarified,with a view to reasonably distinguishing their functions.After having an accurate understanding of the problems in the existing regulatorydepartments' exercise of functions and reasons thereof,and in accordance with the factors for function deployment of the regulatory agency,the functions of regulatory agency may be divided into internal functions and external functions subject to the targets and focuses of such functions.The internal functions focus on the management of assets held thereby,i.e.the target thereof is state-owned natural resource assets,including but not limited to registration,asset classification and other functions,while the external functions focus on the supervision of state-owned natural resource assets,i.e.the target thereof is the users and other subjects of state-owned natural resource assets,including but not limited to delegate function.
