Research On The Improvement Of The Legal System Of The Ownership Of Wild Animal Resources In China

The importance of wildlife resources for human beings is self-evident.It has social and ecological values,which can be said to be closely related to human development.With the development of society,their value is becoming more and more important.While paying attention to the protection of wildlife resources,we should give full play to its market value,and the key basis of all this is to improve the ownership of wildlife resources.In the tense contradiction between resource utilization and protection,wildlife habitat protection and human survival space expansion,it is urgent to formulate a feasible ownership system.On the basis of consulting the existing data and comparing and analyzing wildlife resources and their related definitions,this paper clarifies the value of wildlife resources on the premise of clarifying the specific path of realizing the object.Then it combs and reviews the current ownership system of wildlife resources in China,mainly from three aspects: subject system,object system and validity system.It points out the deficiencies of relevant legislation in China,which lead to such problems as the absence of state ownership subject,the lack of flexibility in the exercise of wildlife resources ownership,and the subject of rights stipulated by law.Only in the practice of the state,there is a dilemma that the ownership does not match the real name.On this basis,the author hopes to explore the system of wildlife resources ownership suitable for our country based on the characteristics and current situation of wildlife resources ownership in China.It is believed that while perfecting the relevant fundamental legislation,it is necessary to put forward the construction of ownership system based on state ownership and diversified ownership subjects,and to put forward a series of suggestions on the management of national hunting activities,so as to ensure the rational utilization and effective allocation of wildlife resources,so as to promote the economic development of our country.
