Research On China's Environmental Protection Administrative Accountability Legal System

Since entering the 21 st century,China's economic and social development entering a new historical process,with the deepning adjustments of social structure and interest structure,the environment problem is becoming more and more significant at the same time.At the beginning of 2018,the government work report released in 31 provinces and cities,showing that nearly 20 provinces will take efforts to protect environment in first to the third from bottom,therefore the local government to a serious shortage of the importance of environmental protection work.From the practice,the reasons of the poor environment and resources law enforcement,the environmental pollution and the rising ecological destruction problems are same like the local government is not as,treated as and negative environmental governance.Therefore,the current promoting environmental protection in the construction of legal system of administrative accountability is urgent and realistic significance."Ecological civilization system overall plan"," the opinions of the construction of ecological civilization" are both explicitly pointed out that to build the system of responsibility.Revised in 2014 by “the environmental protection law” of the strengthened government environmental regulatory responsibilities.Governments are responsible for the supervision to the environment,if the governments fail to perform or improper performance of their own environmental protection responsibility,they will be on the account.Accountability is the guarantee of responsibility implementation,must accompany with accountability and responsibility.Therefore,the urgent matter is to build environmental protection legal system of administrative accountability,this is to improve the environment and maintain the inevitable choice of public environmental rights and interests,to build a system of responsibility of the government's support,and is the only way to fulfill international obligations.Western developed countries in environmental protection administration accountability system construction has made great achievements,especially represented by America,Germany,Japan,we can learn from the beneficial experience through the study,to promote the development of environmental protection administration accountability system in our country and perfect.There are many deficiencies of China's current environmental administrative accountability system in theory and in practice concrete system,accountability subject,object,scope,procedures,etc.There is a deviation bettwen responsibility to define and concluded that,environmental laws and regulations of administrative accountability to have different responsibility,accountability,responsibility cognizance is not reasonable in practice.Current ongoing environmental supervision accountability is facing many difficulties,inspector accountability accountability storm,inspector accountability of the inner-party laws and regulations and state laws exist overlap.To solve these problems,I think we can be improved from the following aspects: to increase the allogeneic accountability,clear accountability object,expand the scope of accountability,establish a scientific and standardized environmental protection administration accountability program and define the legal.Literature research,comparative analysis and so on are the mainly research methods in this paper.In terms of practice,the environmental problems in China are not optimistic,it's necessary to establish and perfect the legal system of environmental protection administration accountability.The purpose of this paper is to analyse the problems exposed in the our country environment administration accountability,through the use of outside experience,to think the way or method to build and perfect our country administration accountability system of environmental protection,and to speed up the construction of environmental protection administration accountability system in our country.
