The government work report in 2018 once again emphasized the importance of the ecological environment.The work proposal mentioned "We work together to build beautiful blue sky,green land and clear water." The construction project environmental impact assessment system,as an important part of China's environmental protection legal system,is a reflection of the scientific,legal,and institutionalization of environmental impact assessment methods,procedures,approvals,and responsibilities for construction projects.Its research and effective implementation are The international environmental law community has basically reached consensus.The “Environmental Impact Assessment Law” has been in effect for the past 15 years since its official implementation in 2003 and has made significant contributions to the environmental protection of China.However,the system has shown many defects in the process of establishment and implementation.The newly revised“Environmental Impact Assessment Law” on July 2,2016 has filled in some loopholes in the old law,but it has been combined with the implementation in the past two years.Look,there are still some rules in the EIA system that are not accurate and some issues are not involved.Therefore,it is necessary to study the environmental impact assessment system for construction projects.This paper takes the environmental impact assessment system of our country's construction project as the research object,and points out the problems existing in the environmental impact assessment system of the construction project through the literature research method and empirical analysis method.Then we use the comparative analysis method combined with the extraterritorial experience to analyze and propose corresponding solutions.In addition to this introduction and conclusions,this article is mainly divided into four parts:The first part is "Overview of China's Construction Project Environmental Impact Assessment System." In conjunction with the newly revised "Environmental Impact Assessment Law" in 2016,the legal relationship and legal system of China's environmental impact assessment are specifically described.The second part is "the problems existing in the environmental impact assessment system for construction projects in China".First of all,starting from the main body and scope of the EIA system,the conclusion is that the evaluation subject is single and the evaluation scope is too narrow.Secondly,the restatement system for major changes in the construction project is not detailed;again,the environmental protection department focuses on prior management and the punishment method is not appropriate.Finally,the analysis of the public participation mechanism has revealed that the disclosure of information is not perfect and the participants are single.The third part is "Experimental Environmental Impact Assessment System Experience and Reference for China".Through understanding the environmental assessment systems of the United States,Germany,and South Korea,we understand their respective characteristics.For example,the United States attaches importance to the relationship between man and nature.Germany emphasizes cross-sectoral and cross-sector cooperation,while South Korea makes separate legislation on administrative plans and construction projects.Combining with China's national conditions points out that it is worth learning from.The fourth part "improvement of China's construction project environmental impact assessment system of countermeasures." Corresponding to the four issues mentioned above,corresponding proposals have been made to expand the scope and scope of evaluation,implement the system of major changes to resubmit documents,improve the regulatory mechanism,and improve the information disclosure and public participation mechanisms.
