| In recent years,several sensational toxic land events have exposed the serious reality of soil pollution prevention and control to the public.The state has also introduced relevant laws and regulations to curb soil pollution.At the beginning of 2019,China’s first special law on soil pollution prevention and control will be formally implemented.From the legislative trend of environmental protection in China in recent years,it can be seen that the management mode of environmental protection in China is gradually transforming from the traditional command and control mode to the direction of combining command and control with incentive.The introduction of the "law on the prevention and control of soil pollution,it is necessary for soil pollution prevention and control of combing,clarify the related incentive system,analysis of the construction of the incentive system is perfect,there is what is missing and deficiency,this paper summarizes the problem and seeking perfect path,so as to make the soil pollution prevention and control of the incentive system can better assist and promote the implementation of the" law on the prevention and control of soil pollution,play the biggest incentive effect in prevention and cure of soil pollution.This paper is divided into four parts.The first part expounds the connotation,function,goal,characteristics and main classification of the incentive mechanism,and clarifies that the operation goal of the incentive mechanism in the soil pollution prevention and control law is to stimulate the motivation of each incentive object to generate incentives for the motivation of the incentive body.The behavior expected by the main body will ultimately achieve the purpose of prevention and control of soil pollution.Clearly give full play to the incentive mechanism to promote the strong potential incentives for the implementation of the laws,and assist in the implementation of the Law.The second part type analysis of the incentive mechanism for soil pollution prevention and control in China.Firstly,theoretical preparations for typed differentiation are made through the analysis of the subject,object and main forms of the soil pollution prevention and control incentive mechanism.In turn,the soil pollution prevention and control incentive machine is divided into three categories according to the incentive object: the government,the supervisory relative,and the public,and the classification of its incentive mechanism.Pioneering the government’s positive incentives into the soil pollution prevention and control law,expanding the scope of the supervisory relatives,including the third party of soil pollution control,and realizing the value of public participation through incentives to the public.The third part is to analyze the status quo of soil pollution prevention and control incentive mechanism,and summarize the shortcomings of the existence of soil pollution prevention and control incentive mechanism in China.That is to say: the scope of the system design in the legislative aspect is narrow,the system design in the implementation aspect is poor in general operation,the supporting measures for the incentive operation and the relief system are not perfect.In the fourth part,Propose the perfect path of soil pollution prevention and control incentive mechanism in China.Specifically,the realistic shortcomings that are summarized in the third part of the article are targeted solutions.At first,do something to broaden the scope of incentive mechanism;Second,improve the implementation of incentive mechanism and program design;Third,strengthen the cooperation of positive and negative incentives;Fourth,improve related supporting measures;Finally,it is necessary to integrate public participation into the operation of soil pollution incentive mechanism. |
