Research On The Rural Environmental Supervising Under The Perspective Of The New Environmental Protection Law

The 19 th CPC National Congress pointed out in the report that we should speed up the reform of the ecological civilization system,build a beautiful China,and continuously promote the modernization of harmony and symbiosis between man and nature.In recent years,the CPC Central Committee attached great importance to the construction of ecological civilization,carried out a series of institutional design,policy arrangements and pilot exploration,which provided a fundamental basis for the construction of beautiful villages.In 2015,the new Environmental Protection Law came into effect.It emphasizes comprehensive management abilities of the government on rural environment from different perspectives including the rural environment protection,the local government responsibility construction,the law content consummation,the information publicity and the public participation and so on.And it has played a certain positive role to help environmental protection departments to improve the level of rural environmental monitoring law enforcement.As the front line of rural environmental management,rural environmental supervision and law enforcement directly faces the environmental interest groups,goes deep into the environmental pollution scene.So it becomes a sharp weapon to crack down rural pollution.Environmental supervision and law enforcement started late in our country.In2003 the national environmental supervision law enforcement team was finally established.On the whole,there are many difficulties in the rural environmental supervision and law enforcement.First of all,the rural environmental supervision law enforcement legal system problems.The environmental supervision departments are lack of authority,law enforcement basis is insufficient,and the legal guidance to the administrative counterpart is insufficient.Secondly,the rural environmental monitoring law enforcement interference factors.The local government interferes in environmental monitoring,the enterprises are lack of awareness,the rural environmental protection organization capacity is insufficient,and the villagers' environmental protection participation is marginalized.Finally,The level of rural environmental supervision law enforcement team is uneven,rural environmental supervision law enforcement comprehensive law enforcement capacity is insufficient,rural environmental supervision law enforcement part of material protection is insufficient.At present,the concept of rural environment,environmental supervision and law enforcement is lack of integrity and systematic understanding in academic circles,and the research cases of rural environmental supervision and law enforcement in practice are also insufficient.Therefore,it is necessary not only to study the basic theory of environmental supervision and law enforcement in rural areas,but also to go deep into rural areas and understand the current situation of environmental supervision.Taking the theoretical research of rural environmental supervision and law enforcement as the starting point and taking history as a mirror,the whole article clarifies the development course of rural environmental supervision law enforcement in China,and introduces the implementation situation and characteristics of rural environmental supervision law enforcement since the implementation of the new environmental protection law.Based on the field investigation the obstacles of law enforcement in rural environmental supervision were put forward.To overcome these obstacles,it is proposed that the top-level design of rural environmental supervision law enforcement should be optimized reasonably,the relatively independent rural environmental supervision law enforcement environment should be constructed,the comprehensive coordination and law enforcement ability of rural environmental supervision should be strengthened,and the rural environmental supervision law enforcement should be perfected.Supervision and promotion of rural environmental supervision and enforcement of talent and material protection of specific measures are to be improved.And according to the existing supporting policies,it puts forward provincial environmental protection agencies supervision and enforcement vertical management system reform proposals,the State Council institutional reform program on rural environmental monitoring and enforcement of the impact and recommendations.
