| The increasingly serious environmental problems have affected China's social development and normal people's life.The slow action,inaction and disorderly action of local governments and related departments in environmental area makes the environmental problems even worse.In order to rectify the absence of environmental protection work,promoting environmental protection work and solve the environmental problems,the CPC Central Committee and the State Council have formulated the environmental protection inspection system,which is a useful exploration for the strategic transformation of environmental protection in China.It is also a useful attempt to urge local environmental protection problems to be solved,to implement the joint responsibility of the Party and the government in environmental protection work,and to promote the construction of ecological civilization.This legal institution has been played for nearly 20 years and it plays an important role in the environmental protection work.However,there are still many problems in theory and concrete operation in the environmental protection inspection and there is still a lot of room for improvement.This article points out that the environmental protection inspection is a superior institution which is conducive to optimizing the system of environmental administration in China,implementing environmental protection work,realizing " co-responsibility of the party and governments ","one post and two responsibilities",and accelerating the construction of ecological civilization in China by analyzing and summarizing the development,functional characteristics,significance and mission of the legal institution of environmental protection inspection in China.China's environmental protection inspection is divided into two parts: regional environmental protection inspection and central environmental protection inspection.While it has achieved positive results in the actual operation at this stage,there are still some problems,such as lack of legal basis,unclear legal status of inspectors,mismatch of responsibilities and powers,lack of effective information sharing and circulation system,and imperfect accountability mechanism in the process of inspection.Therefore,in view of the target of environmental pollution control in China,this article analyses and draws lessons from the environmental protection inspection of foreign counties and constantly promotes the improvement and perfection of the legal institution of environmental protection inspection in China.In the area of regional environmental protection inspection,firstly,we should formulate relevant laws and regulations of environmental protection inspection,build a complete legal system and provide sufficient theoretical basis for environmental protection inspection;secondly,we should clarify the legal status,powers and responsibilities of the main body of inspection and give the inspectors enough power;thirdly,we should build an efficient information sharing and exchange platform;fourthly,we should establish a coordination and cooperation mechanism with local governments and environmental protection departments.Fifth,we should improve the mechanism of public participation to ensure public participation in environmental protection inspection and environmental work.In the aspect of central environmental protection inspection,we should improve the relevant legal basis,guarantee the authority of the inspection and the main body of inspection;standardize the accountability mechanism in the process of environmental protection inspection and guarantee the credibility of environmental protection inspection;finally,we should improve the supervision mechanism of environmental protection inspection institution itself to ensure the fair operation of the inspection institution. |
