A Study On The Construction Of Legal System Of Carbon Emissions Trading Of Shipping In China

At present,the legal system of carbon emission trading in China had made some achievements after pilot experiments.The current legal system of carbon emissions trading was not applicable to the maritime industry,and the trend of carbon emissions in the maritime industry was gradually increasing,which has a great impact on China and even the global climate change.It is of great significance to control the greenhouse gas emissions from marine transportation.By expounding the basic concept and principle of marine carbon emissions trading system,this paper analyzed the necessity and feasibility of constructing China's marine carbon emissions trading system based on the experience of foreign marine carbon emissions trading,improved the basic carbon emissions trading system,and analyzed the core elements of it.This paper was divided into four chapters.The first chapter was the overview of marine carbon emissions trading system.It expounded the meaning and impact of marine carbon emissions and the particularity of marine carbon emissions trading system;analyzed the basic principles to be followed and put forward solutions for the coordination of different principles;collected and collated the current international exploration of marine carbon emissions trading systemThe second chapter analysed the necessity and feasibility of constructing China's marine carbon emission trading system.It was not only out of an objective demand,but also out of subjective considerations.Objectively,the climate was gradually warming;the emission reduction was urgent;the pressure caused by the EU possible emission reduction measures and the effect of energy efficiency rules were insufficient.Subjectively,China also needed to achieve the promised emission reduction targets.The feasibility included being based on the theory of multicentric governance,consistency with the provisions of international conventions,and the support of our domestic legislation and practical experience.The third chapter was the improvement of the legal framework of China's carbon emission trading system.This included,on the basis of clarifying the relationship between greenhouse gases and atmospheric pollutants,achieving coordinated control at the legal level;and upgrading the legal level of national and local normative legal documents at the regulatory level.The fourth chapter was the design of the core elements of the system of China's marine carbon emissions trading.Because of the ship-related factors,the marine carbon emissions trading system had a certain foreign-related nature,and its applicable geographical scope,subject and quota distribution were different from the general carbon emissions trading system.The author of this chapter focused on the demonstration of its particularity.
