Study On Legislation Of Nation Park In Our Country

At present,although many countries have established the national park system,the National Park still belongs to the category of emerging things in our country.Since 2015,China has established ten pilot areas for national parks,and explored the most appropriate way to develop the national park system through pilot activities.Due to the late start of the national park system in China,the arduous task of the pilot reform,the current laws and regulations,management system and operation mechanism have not yet formed a systematic orderly whole.Therefore,we need to strengthen the relevant legislative activities of national parks on the basis of summarizing practical experience,clarify the basic theory of national parks through legislation,standardize the management mechanism,and promote the national park system construction.This has its own significance.Legislation is a strong guarantee to promote the value of ecological resources,scientific research and cultural value as well as economic value of national parks.It is also an important way to improve the ecological rule of law and practice the value pursuit of environmental law in the context of the reform of ecological civilization system.In short,to establish the legal guarantee of national parks is not only to meet the needs of the current development trend of pilot activities,but also to solve the obstacles in the current pilot work and standardize the management and operation of national parks.It is not a castle in the air to perfect the National Park legislation.It has the corresponding theoretical and practical basis in China.Although there are many obstacles in this process,the promulgation of the National Park Law is the most effective way to solve the problems and ease the conflicts of interest.In addition to the summary of practical experience,it is also inseparable from the reference of foreign national park legislative experience.This paper mainly introduces the development background,legislative experience and legal system of national park system in the United States and Japan.Learning the successful experience of foreign countries is an essential step in our legislative process,but how to carry out our national park legislation on the basis of summing up the experience and facing the problems directly is an important part of the article.We should establish a legal guarantee system with the National Park Law as the core.And we should make clear the concept of National Park,set up the basic principles of National Park,and further improve the planning in our national park system through the form of legislation Access system,property right system of natural resources,franchise institution,public participation system,fund guarantee mechanism,ecological compensation system,supervision and legal liability system.
