Objective:This paper analyzes and discusses the current situation of Chinese medicine patent protection in China and summarizes the existing problems in Chinese medicine patent protection.By learning some valuable experiences from foreign countries,we can find out our own shortcomings.We can put forward the strategy for strengthening Chinese medicine patent protection and promoting the development of various undertakings of Chinese medicine.Methods:Through the website of the State Intellectual Property Office,SooPat and other ways to search relevant data on Chinese medicine patent protection.Literature analysis and quantitative analysis are applied to analyze and summarize Chinese medicine patents.Descriptive research method and experience summary method are used to describe the laws and current situation of Chinese medicine patent technologies.And using experience summary method to summarize experiences.Results:The number of patent applications continues to increase but the overall quality is not optimistic.This is closely related to Chinese understanding and emphasis on the protection of traditional Chinese medicine patents.Many patents are not properly protected.Conclusion:Many reasons are bound to affect the development of Chinese medicine patent protection in our country and some countermeasures are needed to deal with the corresponding situation.In the future,the focus of Chinese medicine patent protection should be changed from quantity to quality.Through the cooperation of many aspects and departments,the development of Chinese medicine achievements will be promoted and the comprehensive competitiveness of Chinese medicine in the world will be improved.
