Research On Kunming Marriage And Family Cases In The Beijing Government Period

Kunming archives preserved early marriage class files with a total of 11 judgments of the republic of China,in this paper,the study of Kunming in the early days of marriage and family type of sentence,through to the Kunming archives place trial related data,using the corresponding research methods,to Kunming in the early days of marriage and family cases of local trial verdict,the case type classification and its verdict,and comment on it.This paper is divided into five chapters.The first chapter introduces the development of Kunming's judicial system in the late qing dynasty and the early republic of China.The second to fifth chapter respectively from bigamy,and induced,slightly induced and the sale of marriage type judgment four aspects of Kunming early republic of China marriage and family judgment data collation and research.Through the study of Kunming marriage and family judgment in the beginning of the republic of China,on the one hand,we should pay attention to the change of the state level,on the other hand,we should also pay attention to the local and relevant customary law and folk law of Kunming marriage society.From the perspective of social history,primary this time period and the period of the republic of China of Kunming region,social customs and cultural concepts are dramatic changes,the rights of women in the marriage changes in women s status has improved,some women began to express their rights of twists and turns,but the person was firmly bound in the family,legal status and social status as a vulnerable groups are far than her husband.
