By defining unfair trade practices on the Internet and understanding the types and characteristics,we can have a preliminary understanding to the Internet unfair trade practices.From the perspective of jurisprudence,the Internet unfair trade practices infringe private property and public law;the Internet has caused influence such as squeezing competitors,reducing consumer's welfare and economic efficiency Therefore,establishing the legal regime to regulate the Internet unfair trade practices is necessary.Anti-Unfair Competition Law and Antitrust law of Korea and Japan provide for the relevant legal system Internet unjust trade practices.From the legislative purpose,behavior identification and accountability point of view,the main South Korean anti-unfair competition law regulation of Internet operators to take improper means to obtain competitive behavior of others,Antitrust law have to achieve balanced development point of view,apply the rule of reason to define"unfair" and "unjustified" unfair trade practices,provides for administrative liability of Internet operators,civil and administrative liability;Anti-unfair competition Law of Japan belong to the civil law,focusing on Internet operators protection of private rights,Antitrust laws focus on social justice,freedom of competition in order to maintain,regulations impede fair competition risk behavior,and provides for administrative and civil liability internet unfair trade practices.In view of the conduct on the status of anti-monopoly legislation in the absence of unfair trade practices of Internet analysis system,the Internet should be increased in unfair trade practices legislation,And it is necessary to improve the performance of a predetermined type and build diverse recommendations liability system in order to promote fair market with competition and liberty.
