Since the reform of film industry,domestic film market is taking tremendous advance which appeal to plentiful investment.Together with the trend of film financialization,securitization of film usufruct is bound to emerge.Film financialization in China has break the traditional mode of asset financialization.However,due to the vacancy of legal regulation,film financialization in China has caused incessant disturbance.Notwithstanding the coalesce of film and internet financial platform is the irresistible trend,there are crises,chaos and mistrust back into the reality.In this general context,this article chooses the legal regulation of film financialization as the topic,which will help to provide theoretical pillars to practical work.It is of great value to discuss on the feasibility of legal regulation of film financialization in the theoretical level.This article can be divided into three parts,including introduction,main text and conclusion,and the main text consists of four chapters:The first chapter gives a general introduction of film financialization,coming up with the connotation and character of film financialization based on previous research and concluding that film financialization in China is to take the future earning of a film as collateral to raise capital via transferring share of film usufruct.Then this chapter also proves that the feasibility of legal regulation of film financialization in China through clarifying the legal nature of film usufruct and specific rules of China.The second chapter discuss the three-existing mode in film financialization of China and the relationship among them by case analyze.Via this,the second chapter come forward four major legal vacancies in the process financialization,namely the validity of transferring film usufruct,the legitimacy of securitization performed in Internet platform,the vagueness in legal regulation of box office fraud and vacancy:in the regulation on market maneuver.The third chapter cites a case of film "IP man 3" to further analyze the difficulty in the practice of legal regulation of film financialization in the basis of the discussion of the second chapter.The fourth chapter comes up with some suggestions to improve the legal regulation of our countries film usufruct,consisting the establishment and perfection of the mechanism of credit assignment in China,the legal regulation mode concerning the coalesce of Internet platform and asset securitization and jointly supervision of film governing authority and security market supervisor.
