Reflections On The System Of Limintation Of Rrosecution In Our Country

The introduction of case quality lifelong responsibility system lead to conflict between lifelong prosecution of judicial responsibility system and limited prosecution of criminal liability system.This article starts from the reasonable value of the two systems,thinking about period setting,period calculation and exclusion of the system of limintation of prosecution.And puts forward some specific proposals,with good wishes that the system of limintation of prosecution will be better and make case quality lifelong responsibility system compatible and appropriate in the limintation of prosecution system,with a view to attract attention and solve.This artical is divided into five chapters.In the first chapter,the author summarizes the establishment of case quality lifelong responsibility system analyses the responsibility under the system,and analyzes the reasonable value of case quality lifelong responsibility system and limintation of prosecution system,and finds out the convergence between them,and provides the basis for the improvement and application of the two systems.In the second chapter,the author reflects on the establishment of duration in the system of limintation of prosecution.Through the review of the limitation period for the death penalty,life imprisonment and combined punishment for several crimes,proposes the establishment of the system of limintation of prosecution in China.And thinks about the implications of the system of case quality lifelong responsibilityIn the third chapter,the author thinks about the starting calculation of the limitation period for prosecution,mainly from the starting system to find out some suggestion for the special provisions of the starting point under the system of case quality lifelong responsibility.In the forth chapter,the author introduces the exclusion of limintation of prosecution system,and interprets "no restrictions on the limitation period for prosecution"and the approval of prosecution of limintation of prosecution system in China.At the same time,elaborates the dangers of the illegal and criminal acts of judicial personnel in handling the case under the system of case quality lifelong responsibility.And Put forward the feasibility of excluding limintation of prosecution system.
