On The Dilemma And Outlet Of Administrative Punishment For Minor Offenses

Minor violations of law in the social life in a large number of administrative punishment law,although the punishment for illegal acts have clearly defined,but these Provisions for a large number of minor violations and can not play a good role in the control.Administrative punishment in the "legal principle","fair,open the principle","the principle of punishment," and other principles applied to the phenomenon of the principle of the phenomenon of a minor offence.This paper,through the distinction between minor violations and other illegal activities,through in-depth analysis of the psychological causes of minor violations,legal and social roots,that the reason is unable to curb the spread of minor violations,the legal system of administrative punishment in the form of administrative punishment,the way and other aspects of the establishment of many unreasonable.Compared to the United States,Britain,France,Singapore and other developed countries,our country for minor violations of the concept of punishment is too conservative,the punishment is too simple,the punishment is very small,not enough to make a good citizen to form a good habit,leading to a very low price of civil law.Based on this,this paper considers that the following measures should be taken to change the administrative penalty dilemma,set a more reasonable rule system:One is to adopt more flexible way of law enforcement for minor violations;two is to set a higher limit for minor violations of property penalty;three is the minor violations included in the personal credit system;four is for minor violations of priority to be exposed to the public;the five is to create a social atmosphere of compliance with the law;six is to improve the governance of minor offenses the seven is to improve the system;minor violations punishment means;eight is to regulate the law enforcement personnel for minor offenses.If these measures can be truly implemented,is similar to the Chinese cross "minor offenses such will be greatly reduced,the administration will be more smooth,the whole society's awareness of the rule of law and legal literacy will be greatly improved.
