The Study On Family Heritage Trust System

In their history of about two thousand years,the Romans created many remarkable legal treasures which still influenced the modern world and formed the modern continental law system.Rome legal history witnessed the history of Rome,and through those legal systems in the roman law,we can restore the Roman scenes of life.Not only in the Roman period,those legal systems also play an important role in modern,such as family heritage trust system.In many modern countries,family heritage trust system has changed in its system design and formed two kind of patterns:subsequent succession system and fiduciary substitution system.Meanwhile,its function of maintaining the stability of family property has been turned into today's various functions.There are two reasons for these changes:on the one hand,the inheritance system has been changed;on the other hand,the history of the development of social and law of every modern country is different.The general ideas of this paper is as follows:The first chapter,based on many legal words in the original literature in Rome period,this paper analyzes and explores the origin and causes of the family heritage trust system in Rome,and on this basis,it summarizes the functions and characteristics of the family heritage trust system.The second chapter,on the basis of the above,this paper makes a detailed analysis of the framework and content of the family heritage trust system through the concrete legal words.The third chapter,through the analysis of the provisions of the family heritage trust system in modern countries and compared with the Roman family heritage trust system,this paper will try to find out their differences and the reasons for the changes.The fourth chapter,based on the reality of our country,this paper attempts to explore the possibility of constructing the family heritage trust system in our country.Combined the above analysis with the situation of our country,this paper will strive to provide some macro and micro views of building the family heritage trust system in China.
