The original purpose of the establishment of criminal law is to defend the society from the invasion of illegal acts to protect the people's lives and property.Provisions in the criminal law as a powerful weapon against crime,with obvious limitations,the punishment can only be punished by the already acts,can not be punished for criminal acts without criminal responsibility,so that the scope of punishment blank.And the emergence of security sanctions system,to fill the no responsibility for the crime of punishment.The security system as one of the most important criminal law systems in the world is widely recognized in the world.Security sanctions are defined by the provisions of a national criminal law,those who are not responsible or limited liability,as well as penalties after the completion of the punishment or parole after the crime,because of its considerable personal risk,in order to achieve the defense of society,the elimination of the special The purpose of the personal risk of the population,the state declared by the court.On the basis of studying the theory of security disposal system,this paper analyzes and discusses the security measures of China,and looks forward to the development direction of security system in China.The thesis is composed of four parts:The first part studies the basic theory of security measures,expounds the concept,development and connotation of the security system.The second part of the domestic legislation of the security measures,the analysis of the nature of the domestic security sanctions,the implementation of the situation in recent years and the effectiveness of China's security measures in practice;the third part of the external security sanctions system,elaborated China's security measures in practice And evaluation of China in recent years,the new legislation and the abolition of security sanctions.From the new legislation to abolish the abolition of reeducation through labor and then to the new legislation prohibits,more and more emphasis on social security and the correction of the perpetrators;the fourth part from the construction of security measures and the application of security measures put forward China's security measures System in the future construction of the proposal.
