| With the deepening of economic reform,China's urbanization has been developed by leaps and bounds in recent years.Urbanization has brought about the vigorous development of urban real estate industry.The emergence of residential quarters has been developed.The property management of supporting services has become an important industry.Property disputes become a new point of social contradictions,a large number of property disputes into the court,the number of cases doubled year by year,the new type of property disputes cases gradually increased.The proportion of property disputes increased significantly in the civil cases court accepted.This paper adopts the empirical research method,through the collection of case sample analysis,combined with the current relevant legislation and theoretical research results,analyze the current situation of the present property disputes in civil litigation of our country and its causes,characteristics,types of cases,and the difficulties of property fee disputes,thinking and research solutions,in order to further clarify the legal relationship,improve the existing legislation and improve the ability to deal with the disputes of property.The first part of this paper briefly expounds the main research background of the article,the status and characteristics of the research object.The second part make a brief introduction to the relevant theoretical basis of property,property management,to sort out the classification of legal relationship of property management,and defines the attributes of property service contract.The third part analyzes the difficult problems in the civil litigation of the property fee dispute,.first explains how to exercise the right from the angle of the confrontation between the claim and the counterargument,and then summarizes the experience of trial and discuss the judicial processing opinions on property fee disputes;Finally,it puts forward suggestions on perfecting and improving outside the stage of the proceedings. |
