Overseas purchasing is a new type of online trading which is rely on the electronic commerce,it is the product of The information age.The overseas purchasing promotes the global resources circulation and optimizes configuration of global resources.From the perspective of national interests,it is favorable to promote transformation and upgrading of domestic enterprises and to meet consumer demand in buying cheap and fine products.However,overseas purchasing is a new economic activity.There are many unreasonable and non-standard phenomenon.If we don't have perfect rules and specification to regulate the development of overseas purchasing,it will do more harm than good.In this paper,I analyzed the legal risks in each link of the overseas purchasing in order to find a legal and orderly development rode,including the contract signing,paying and the protection of consumer.There are four parts in this paper.The first is the concept and characteristic and current situation of overseas purchasing.The second is the most important part.There are many legal risks over the purchasing,including the risks facing our country and the risks facing purchasing agent and consumer.The third is talking about to perfect legislation system based on the national conditions in china.Finally,I put forward the idea of perfecting legislation to elaborate the legal norms in the tax and intellectual property rights and the protection of consumer's rights and interests field.The overseas purchasing is a new thing,we should take the objective view to find its advantages and disadvantages.Developing the overseas purchasing is a long process.
