In this paper,we study the problem of "pocket crime".By consulting the literature,we find that the concept is widely used in academia.However,the existing research on in criminal law school is lack of systematic.Therefore,it is of great significance to apply the "pocket crime" to the norms and to implement the principle of legally prescribed punishment for a specified crime.And then through the thought of the crime of guilty and the legal status of the specific charges to explore the value of the meaning of " pocket crime ",in understanding the basic principles of criminal law on the basis of the depth of the search for on the deviation of the value orientation and the lack of crime.Finally,advocate the existence of the necessity of pocket under the premise of the need to explore the legislation and judicial dual norms path.There are four chapters in the text of the article,the first chapter is a brief introduction to the origin of to explore the connotation and extension.The second chapter analyzes the current situation and causes of "pocket crime",finds out the controversial focus of the related problems,and puts forward their own opinions with the case analysis of specific crimes.The third chapter focuses on the legislative thinking of the limitation and application of the "pocket crime",and analyzes the existing problems based on the legislative model and the typing as the starting point,so as to limit and regulate the application of the crime of pockets.The fourth chapter is to try to improve the specific application and explanation of the concept and limitation of the legislation and explanation of "pocket crime",and guide the judicial practice to deal with the related behavior correctly.
