Research On The Legal Coordination Mechanism Of The Interests Of Higher Education

The transformation of interest caused by social transformation has penetrated into every aspects of the higher education system,and the traditional pattern of interest has been broken.From the point of view of the relationship between the stakeholders,there are conflicts and contradictions of interests.As a kind of social norm,the law is applicable to the adjustment of the interests of higher education.In order to make full use of the coordination function of law,we can re-examine the system of universities from the point of view of educational interests,and then construct the appropriate legal coordination mechanism.This study from the connotation of college education of the interests,analysis of the relationship between educational benefits and law,legal interpretation and significance of adjustment in higher education interest distribution and the role of conflict,has a certain theoretical value to promote the coordinated development of higher education interests;and has the reference significance to realize the modernization of higher education reform and the management of universities.In this paper,the theory of stakeholder theory and social law was the theoretical support,through the literature method to collect materials,in order to describe the relationship between the status of higher education interests,combined with theoretical explanations for the idea of research.This paper is divided into six parts.The first chapter analyzes the research background,combing the research status.The second chapter defines the concept and characteristics of higher education interests,and the theoretical basis of this paper.The third chapter and the fourth chapter,from the perspective of the relationship between the University and the external and internal subjects,analyzes the performance of the conflict of interest.The fifth chapter discusses the role of law in the interests of higher education.In the sixth chapter,on the basis of summarizing the types of conflicts of interest,the author establishes the legal coordination mechanism.The four principles of fairness and justice,public welfare,academic freedom and the combination of various methods of coordination should be adhered to in the adjustment of law,and construct the basic coordination mode of the combination of certainty and relative certainty,the combination of adjustment and protection,and the coordination between legal norms and other norms.
