Study On The Administrative Accountability System From The Perspective Of The Government Information Publicity

The regulation of government information publicity has been implemented since May 1,2008,but it does not play an effective role in guaranteeing government to open information according to law over the past seven years.Most researches focus on the government information publicity,but there are less specific research of the administrative accountability system from the perspective of the government information publicity.Focusing on the importance of administrative accountability system in perspective of government information publicity can help to accelerate the construction of the country,the government and the society under the rule of law.This thesis falls into four parts except the introduction and conclusion.The first part is an overview of administrative accountability system under the government information publicity.By defining the meaning of government information publicity and administrative accountability system and its categories,the definition of the administrative accountability system under government information publicity perspective is taken shape.In addition,this thesis analyses the development of the system.After studying the theoretical basis of the government information publicity and the administrative accountability system and analyzing their relationship,this thesis sums up the theoretical basis of the administrative accountability system in government information publicity perspective.The second part analyzes the status quo of the administrative accountability system in government information publicity perspective,the plight it faces and its reasons.Currently,this system has the difficulties of ineffective work of government information publicity,poor accountability allograft and limited cases caused by the government information publicity in administrative accountability.The main reasons for this dilemma are:officials' poor awareness of government information publicity,defects of the regulation of government information publicity and difficulties to combine the accountability under same system and under different systems,etc.The third part analyzes the characteristics and enlightenments of the administrative accountability system in government information publicity perspective of foreign countries including the United States,France,Japan.The enlightenments include:regulating executive power by legislative power and judicial power;improving relevant legal system and strengthening administrative ethics construction;enhancing the legal awareness of both officials and the public to supervise power by rights;acting based on national conditions and step by step.The fourth part provides suggestions to improve the administrative accountability system in government information publicity perspective.By studying China's current problems and analyzing the reasons,and with relatively mature experience of foreign countries,we put forward some basic principles and operational paths for the administrative accountability system in government information publicity perspective.Basic principles include matching powers with responsibilities,making liability commensurate with mistakes,and sticking to objectivity and justice.Operational paths focus on combining the accountability under same system and under different systems,conducting both publicizing and supervising measures,improving legislation and strengthening the law enforcement,and other aspects.
