Research On The Pilot Reforms Of The People's Jury System's Implementation

As an attempt of taking part in the judicial practice of our country for the “layman”,the people's jury system which plays an irreplaceable role in promoting the judicial democracy,judicial justice,strengthening the credibility of the judiciary,the right of citizens to supervise,protect human rights and so on,combines the wisdom of ordinary citizens with the judicial practice experience.But Because of the system design and other aspects of the constraints,the people's jury system in the actual operation,there are still a lot of problems,such as lack of people's jurors "representative","extensive",showing the tendency of "elite" and the "fixed" phenomenon is serious,“accompany without trial”,“the trial without discussion” and “indecisive” problem is more prominent,that has seriously hindered the development of the people's jury system in China's practice.This effort through analyzing the legal and the current implementation of the people's jury system in our country,points out the defects in operation and puts forward constructive opinions.Full text is divided into introduction,text and conclusion,the text is divided into four chapters:First chapter,divided into three sections,through the Anglo-American jury system and the continental law system trial mode of comparative analysis,locates the position of the people's jury system in our country,and then proves the necessity of existence and the necessity of reform of people's jury system in our country.The second chapter,divided into three sections,takes the investigation and analysis respectively from the selection mechanism,the people's assessors and review mechanism,the rewards and punishment mechanism,etc,to understand the people's jury system in our country present situation and problems of the judicial operation.The third chapter,from “the Large Collegiate Bench”,the possible direction of the people's juror system reform in our country,to promote and develop the superiority of the people's jury system in our country's practice by the real cases of Henan Lankao County People's Court on “the Large Collegiate Bench”.The fourth chapter,mainly discusses the improvements of the people's jury system in our country,set up scientific system of people's jury.Strengthening application of people's jury system in the judicial practice of our country by the reasonable construction of people's assessors information database,establishing and improving the reference review mechanism,moderate strengthening people's juror decision effectiveness and responsibility measures and so on.
