Public Figures' Spiritual Personality Right

Nowadays,science and technology develop with each passing day,and diverse transmission mode of information become more convenient and fast.It is inevitable that there is a considerable amount of false or not objective information on the Internet,which must infringe some people's spiritual personality right,especially public figure.In recent years,numerous cases that public figure sue the press for tort happened,however Chinese law has not established the relevant rules of public figure,so most cases ended in the press losing.In the long terms,the enthusiasm and initiative of the press to report news will greatly reduce,which will interfere with freedom of expression in our country and damage the public right to monitor and to know.In this article,I first introduce the origin and classification of public figure briefly.Then I propose the criteria of public figure which has not been fully discussed,including popularity,publicness and voluntary.After that,I discuss the necessity of restrictions on public figures' spiritual personality right through measuring the interest.In order to establish special rules for public figure in China,I recommend to set up the principal of actual malice and make rules about the pure private field of public figure.
