The Realistic Dilemma And Legal Breakthrough Of Physician's Liability Insurance In China

In recent years,how to build a harmonious relationship between doctors and patients has become a hot topic.This also reflects the reality from the side that the tension between doctors and patients has become the current social problems.Medical disputes not only make the relationship between hospitals,doctors and patients destroyed,but also make the normal order of the hospital unmaintained which resulting in many doctors in order to avoid the responsibility of the patients to take defensive treatment,thus forming a vicious circle.In this context,China is more urgent to introduce the relevant physician's liability insurance to resolve medical disputes that could lower the medical risk of doctors.However,China's physician's liability insurance is still in the bud and the executive department has not introduced on the physician's liability insurance normative documents.There is only a few insurance companies setting up the relevant insurance.In this paper,the author will discuss the problems and implementation of physician's liability insurance from the theoretical and practical aspects,then makes suggestions on the perfection of physician's liability insurance in China with reference to the practical experience abroad.Hope this paper could promote and popularize physician's liability insurance to the meager power in the future.This paper consists of five parts,the specific structure and content are as follows.The first part,expounded the duality of medical responsibility from the introduction of the concept and value of physician's liability insurance means that,the professionalism of medicine determines the division of physician responsibility and the separation of medical institutions and the status of practice of doctors in China,.Then explained the significance of setting up physician's liability insurance.The second part,through the search information and field research to visit our current physician's liability insurance in the implementation of the problems and analysis the reasons,problem-oriented,specific issues.The third part discussed the related issues around the design of physician's liability insurance products.Then this part focused on expounding the definition of insurance rates and making the coverage of physician's liability insurance to be clear.Baesd on the previous analysis,the fourth part found out the way out of the development of physician's liability insurance in China,specifically for the construction of compulsory physician's liability insurance at the same time the government should provide what kind of policy support.The fifth part is the conclusion.The conclusion is a summary of the research and discussion of this thesis,and put forward my own conclusions.
