China's e-commerce in recent years has developed rapidly,shopping on the Internet has become a part of people's lives,and,with the "sea Amoy" appears,more and more people,especially young people,like cross-border online shopping,Cross-border electricity business platform also appears,,for example,“ T-mall International”,“Red Book”,“Kao La”and so on.According to the China Electronic Commerce Research Center(100EC.CN)monitoring,survey data show that 35% of Chinese online shopping consumers had cross-border shopping in 2015;China's cross-border electricity retail sales in 2015 reached 751.2 billion yuan,an increase of 69%.The huge cross-border transactions followed the increase in cross-border e-commerce disputes,and more and more highlights its unique characteristics.The traditional dispute resolutionhave been unable to meet the needs of cross-border e-commerce dispute resolution in the financial,human and material resources,online dispute resolution mechanism(0DR)came into being.This paper mainly introduces the characteristics and patterns of ODR and B2 C cross-border e-commerce,and puts forward the future development of cross-border e-commerce online dispute resolution mechanism in China's future,and sets up its own cross-border e-commerce Online dispute resolution mechanism to make some suggestions or comments.The first chapter introduces the characteristics and types of cross-border e-commerce disputes,as well as the disadvantages of the traditional dispute resolution in the settlement of B2 C cross-border e-commerce disputes,make it clear that the cross-border e-commerce disputes' requirements on the dispute resolution mechanism,Required to find a more appropriate dispute resolution mechanism,that is,online dispute resolution mechanism(ODR).The second chapter mainly elaborates the ODR mechanism.The first section introduces the concept and category of the ODR.The ODR in this paper refers to the online dispute resolution mechanism which does not include the online litigation,which is independent of the enterprise.It does not include the internal Dispute resolution mechanism.The second section classifies the ODR,and briefly describes the main forms of several ODR.The third chapter introduces the dilemma and breakthrough of the online dispute mechanism of cross-border e-commerce.The first section highlights the main legal dilemma faced by the online dispute resolution mechanism for cross-border e-commerce.Section II focuses on the analysis of the dilemma of the United Nations International Trade Commission(UNCITRAL)Working Group III document and a number of relevant practical experiences abroad.And provide reference for the establishment of cross-border electronic commerce online dispute resolution mechanism.Chapter four combines the current situation of cross-border e-commerce online dispute resolution mechanism in China.At present,China needs to establish a cross-border e-commerce dispute resolution mechanism to meet the needs of consumers for dispute resolution.Combing out the shortcomings of our country in its development,find the reason,and give the corresponding opinions and suggestions.
