On The Ways Of Sinicizing Family Trust

As the saying goes,"Wealth does not pass three generations," the family inheritance of wealth always is a problem.With the rapid growth of private wealth in China in recent years,the number of high net worth is also expanding,and with the growth of these high net worth,wealth protection and inheritance has gradually become the focus of attention.Under this background,family trustin our country takes root,and gradually grows and develops.In the developed countries and regions where the trust development is more abundant,the family trust has developed into an important tool for the protection and inheritance of property.However,in our country,the advantages of the family trust are difficult to get play due to the more legal obstacles.Despite the rapid development,it has entered the bottleneck period,if unable to follow up the establishment of a sound and reasonable legal system of trust,the family trust is difficult to further development.The first part of this article mainly summarizes the necessity of family trust in China.By introducing the historical origins of the family trust,the author sums up and summarizes the legal characteristics which are different from other trusts.From the aspects of the market demand of our family trust,the limitations of traditional wealth inheritance tools and the function of family trust to analysis and explore the necessity of family trust in China.The second part of this article mainly explores the existing path of family trust in China.At present,the main path of our family trust has the gradual systematization of the family trust legal system,and the beneficial practice of the domestic major trust institutions and private banks through the issue of family trust products.The last part is about the challenges and the perfect path of family trust in China.First of all,according to the existing practice of family trust in our country,we can find out the existing problems,and then,according to the method of comparative analysis,we put forward some suggestions to further improve the legal system of family trust in our country in order to deal with the above challenges.
