On The Procuratorial Supervision Of Civil Mediation Agreement

Mediation is an effective way to solve disputes,it is conducive to resolving social conflicts and maintaining social harmony and stability.In China's civil procedure,the court mediation is an important means to solve civil disputes.With the development of society,civil disputes are becoming more and more complicated.In order to give full play to the role of mediation and solve the problems existing in the court mediation,it is necessary to incorporate the court mediation into Supervision.The revised civil procedure law of the people's Republic of China formally established the procuratorial supervision system in 2012.The establishment of this system has expanded the scope of procuratorial supervision and improved the system of civil prosecutorial supervision.As a new system,it also exposes its own problems while regulating the court mediation.In this paper the basic connotation in the procuratorial supervision,through comprehensive analysis,pointed out that the existing law system of procuratorial supervision of civil mediation is too broad and lacks of operation;lack of response mechanism of procuratorial suggestions;case is difficult to obtain;the facts of the case and evidence investigation of difficult problems,and put forward corresponding countermeasures,so as to better improve the procuratorial supervision system in china.
