Research On Validity Of The Record Contracts For Construction Project

In recent years,the number of contract for construction project related disputes presents a rising trend along with the rapid development of construction market,in order to avoid government regulation,appeared in the practice is not in accordance with the record contract,but privately sign supplementary agreements and other documents to the phenomenon of project construction and the settlement price,causing a lot of shoddy construction,brings to people's life and property security threat,but after bidding law enacted did not contain the type case rising trend,prompted the author to study the causes of the problem.In view of the relevant laws and regulations have yet to be perfect,in the judicial practice.The court of the validity of the the record contract concluded that there is more controversial,the research of the record contract for construction project and is of positive theoretical value and practical significance.This text is divided into four parts,first of all,it introduced the concept of contract for construction project for the record and characteristics.To define the record contract mandatory registration contract and voluntary for two pairs of concepts,analyzes the causes of this phenomenon and harm.Second,the author collected the supreme law for the typical cases of contract for construction project for the record to judge,by the result of the case the referee,teasing out the record contract disputes the focal point of the problem,question,on the record contract effectiveness problem analysis of the current judicial practice for the record contract effectiveness of path.Thirdly,this paper analyzes the limitation of the validity of the record-keeping contract and the difficulties of the judicial organs in judging the disputes in the construction project.Finally,summarize the limitation of the validity determination regulation of the existing construction project record contract,and put forward my own thoughts and suggestions.
