The Characteristics And Influencing Factors Of The Lightness Of The Sentencing Of The Case Of Violent Killing Were Studied In The Last Three Years And 104 Cases

The author noticed that in recent cases the penalties are getting lighter and lighter.The author looked for verdicts which included elements such as "domestic violence"and "victim death" from the website of the Chinese Verdicts.By using the method of empirical research,the author intends to conclude the common characteristics of those cases,look into the implementation of law and sentencing considerations and to further investigate which factors can ease the sentence and finally analyze those factors.This research can not only provide an overview of the current legal practice and find the problems in the implementation,but can also find out the sentencing factors.The studied sample cases are from 2014-2016 and are included in this thesis.The author concludes the sentencing practice in the recent three years and conclude the features of varied sentencing.Furthermore,the author analyzes the cases based on the impact of laws and regulations,public opinion and scientific kno,wledge.By comparing the sample cases,the author analyzes pros and cons and provide further suggestions to the legal system in order to improve the implementation of the legal texts.The author also suggests that there should be a boundary for the impact of public opinions.Scientific knowledge can also play an active role injudicial trials,such as introducing the concept of "battered women syndrome " and allow experts to testify in court in order to increase a gender perspective.The aim of this thesis is to explore the significant impact of the sentencing consideration in these cases.The author believes the sentencing consideration is directly relevant with judicial justice,and further influences the publics image of the juridical system.Since verdicts and sentences varies a lot for similar cases in different regions,this has undoubtedly damaged the credibility of the judiciary and has a negative impact on the social and political environment.Therefore,it is necessary to focus on the importance of the sentencing consideration,to strengthen the sentencing guidance,in order for each individual to feel they are treated fairly and justly by our legal system.
