Current Situation And Analysis Of Civil Legal Regulation Of Private Lending

Private lending is a very common and important way of financing in the financial market of our country.Compared with complicated procedures and harsh conditions in the formal financial institutions,private lending are widely used in the society because of its flexibility and convenience.In recent years,with the rapid development of market economy,private lending is more frequent in the daily life and plays an important role in optimizing resource allocation,Activating the function of unused money,making up for the disadvantage of formal financial institutions,promoting the development of financial industry and resolving individual economic difficulties.But at the same time,the regulations and laws of private lending are faced with difficulties because of the imperfection of current civil laws.when the disputes caused by private lending is increasing,it is particularly urgent to improve the laws and regulations accordingly.This essay mainly starts from the typical case of Civil private lending in Hanzhong City.Basing the essay on analysis of current situation of Hanzhong private lending and related theories,I analyze the legal regulation of civil private lending in China,and put forward the corresponding legislative proposals,aimed at improving legal regulation of private lending in china.This paper consists of five chapters.The first chapter mainly introduces the research background of the subject briefly,and illustrates the purpose and significance of the research.The second chapter mainly analyzes the concept,characteristics,classification and causes of private lending.The third chapter mainly analyses and summarizes the conditions and characteristics of private lending disputes in Hanzhong city and Ningqiang County.The fourth chapter mainly analyzes the defects of the Civil legal regulation of private lending.The fifth chapter summarizes the experience of foreign countries and Hong Kong of China and Taiwan of China,and proposes suggestions on the legislation of private lending in China's mainland.
