Research Report On The Sexual Assault Of Left-behind Girls In Rural Areas

In recent years,with the exposure of online media,the sexual assault of left-behind girls has been increasingly revealed by the online media,which has attracted wide attention from the whole society.For example,the sexual assault cases of left-behind girls in rural areas,such as 12 left-behind girls sexually assaulted by the headmaster of a village primary school in Bijie,Guizhou Province,and a 12-year-old left-behind girl sexually assaulted by 18middle-aged and old men in a village of Xingye County,Guangxi Province,were widely exposed by the news media,attracting deep concern and research of various experts and scholars in the fields of the jurisprudential circle,judicial practical circle,social science and psychology.Owing to the uniqueness of the dual structure of urban and rural areas in China,the rural youth labor force's working outside has become the choice of the times,and accordingly the number of left-behind children in rural areas has increased dramatically.Due to the low monitoring quality and the lack of sexual security education,a considerable number of left-behind girls in rural areas are under threat of sexual assault.To solve these problems,the solution to the frequent sexual assault of left-behind girls in rural areas is indispensably based on the in-depth research of the sexual assault cases of left-behind girls in rural areas,which is of profound significance to the protection of left-behind girls in some County,and the building of peace and masses satisfaction.This paper mainly researches the sexual assault cases in rural areas handled by the People's Procuratorate of some County,Guizhou Province since 2013,and proposes some suggestions for how to further punish and prevent such crimes on the basis of relevant subject knowledge in the science of criminal law and field investigation,in combination with the practical experiences of the author and the overall analysis of the status quo,characteristics and reasons of sexual assault crimes of left-behind in rural areas of some County.Apart from introduction,this paper consists of five parts:Part One elaborates investigation background,purposes and methods.The author is triggered the thought of writing this paper under the background of the increasing social problem of sexual assaults of left-behind girls and frequent sexual assaults of left-behind girls in some County,hoping to find out the reasons for the frequent sexual assaults of left-behind girls in this county,to attract the attention from the society,government,schools and families and to propose countermeasures and suggestions for effective prevention of sexual assaults of left-behind girls therein.Investigation methods consist of data investigation method,interviewmethod,questionnaire survey and chart analysis.Part Two introduces the investigation,including four aspects,which firstly introduces the number and proportion of sexual assaults from 2013 to 2016 in this county,secondly the charges involved in sexual assaults of left-behind girls in the country and the severity of sexual assaults in the cases,thirdly the development of school sexual security education and legal education in the county and fourthly the development of protection of left-behind girls therein.Part Three analyzes the characteristics of sexual assault of left-behind girls.This part analyzes and summarizes the sexual assault of left-behind girls in some County,concludes the typical characteristics of such crimes under the current social background,mainly including the contingency of criminal motive,the remote and secluded location of the cases,the diversity of criminal subjects;low age of the sexually assaulted girls and the huge impact on the victims.Part Four analyzes the reasons for sexual assault of left-behind girls in some County.There are many reasons for sexual assault of left-behind girls with different reasons in different regions and the reasons for sexual assault of left-behind girls in this county include weakened combat arising from difficult investigation and evidence obtainment,the absence of sexual security education of the victims and low quality of guardianship of left-behind girls,in which the first reason is analyzed in the perspective of inadequate capability,evidence consciousness and onsite investigation capability of the procuratorial organs,inadequate guide of the procuratorial organs on investigation and evidence obtainment of the investigation organs and the stereotyped thought of the victims and the absence of evidence awareness.The absence of sexual security education of the victims stems from the absence of sexual security education of the family and the school.The low quality of guardianship of left-behind girls stems from low quality of guardianship of the family,the government's failure to take agent guardianship duty and the schools' failure to set up key attention system for left-behind girls.Part Five proposes the measures for prevention of sexual assault of left-behind girls,mainly including,the first is to strengthen the combat of sexual assault of left-behind girls,improving evidence collection and onsite investigation capability of the investigation organs,enhancing the guide of procuratorial organs on investigation and evidence obtainment of the public security organs and promoting legal publicity and security control of the concentration area where the left-behind girls live;the second is to strengthen security education withoutdelay,propose feasible solutions to the weakness in security education of left-behind girls from the patriarch practically to be the first person responsible for security education and the school to attach great importance to security education.The third is to improve the guardianship quality of left-behind girls from the perspective of family guardianship quality of left-behind girls,the government's custody duty for left-behind girls,the school to set up tracking responsibility system for left-behind girls and the intensified punishment.This paper proposes the control and prevention measures as for the frequent sexual assault of left-behind girls in some County,hoping to offer direction for the prevention and control of sexually assaulted left-behind girls therein.
