A Study Of Appraisal Costs In Civil Litigation

In China's civil litigation legislation,the identification,one of the legal types of e vidence,plays an irreplaceable role in the civil judicial practice.At present,there are many problems in the cost of civil litigation appraisal in our country.The most impor tant and most fundamental problem is that the positioning of the appraisal fee is uncl ear.This leads to the unequal constitution of the appraisal fee,the burden of the appr aisal fee and the prepayment mechanism.Reasonable and cost-effective management of management and supervision.The purpose of this thesis is to define the nature of the appraisal fee correctly and try to provide some suggestions for building a scientific a ppraisal fee system.The text is divided into four parts:The first part is the summary of the cost of civil litigation appraisal.Firstly,the concept of civil litigation appraisal is analyzed.Secondly,it analyzes the function of c ivil litigation appraisal fee.The second part is the study on the cost of civil litigation appraisal in the region and related areas.In order to provide reference for China's civil litigation appraisal f ee system,this paper gives detailed introductions and analysis of civil litigation apprai sal fee systems in Germany,Japan and Taiwan through a comparative study.The third part is the history and current situation of the appraisal fee of civil liti gation in our country.First of all,the historical evolution of China's civil litigation ap praisal has been studied and analyzed;secondly,the author focuses on the main probl ems of the current civil litigation appraisal costs.The fourth part is the improvement of the cost of civil litigation in our country,which is the focus and difficulty of this paper.On the basis of the above discussion,this part puts forward the concrete measures and suggestions to improve the cost of ci vil litigation appraisal in our country.
