Research On Copyright Issues Related To Short Videos

With the development of mobile network technology and the popularisation of smart mobile terminals,information dissemination has been developing in the direction of fragmentation.Internet users are increasingly demanding the interactivity and immediacy of content regarding social networking,information,and so on.The short videos which are short but contain rich contents fill the needs of internet users.Its close integration with social networks and consulting media caters to the current consumption habits of fragmented content in the mobile Internet era and has gradually become an important form of Internet information dissemination.After the "barbarous growth" in the past two years,some infringements of short videos have emerged,and the related copyright issues need to be sorted out.This article will systematically study copyright issues related to short videos from the following aspects:The first part mainly explains the definition of the short video and its copyright.Firstly it defines the short video from the definition of the industry as well as features,type and industry mode of the short video aspects;then it describes the substantial factors for acquiring the protection of the copyright by original analysis.The main content of the second part is main forms and rights’ ownership of short videos.This is an analysis of the formal requirements for the acquisition of short video copyrights.It mainly includes three aspects:the owner of the copyright of short videos,the way to obtain rights,and the specific attribution of rights.The third part mains describe the rights content and limitation of the copyright of short videos.By analysing the rights content of short video types,the right content of short video copyright owners is clarified.According to the principle of balance of interests and the characteristics of the Internet at the present stage,the limitation on short video copyright should use a combination of fair use and implied license.To balance the interests of copyright owners and the interests of the public,ensure the orderly development of the short video industry.The main content of the fourth part is the identification of the infringement of short video and the duty of care of the relevant subjects.Explained the direct infringement and indirect infringement of short video in the network environment,and then analysed the short video transmission platform and creators’ duty of care.
