With the deep development of the online game industry and the expansion of the scale of game users,as a rising industry,online game live has increasingly become one of the important industries of the national economy,and it is also changing the way of entertainment virtually.The copyright disputes caused by the live game make people begin,to pay attention to the copyright problem in this field.After all,online games have their own unique features compared to other works,and can not be protected only by the copyright of computer software.Online games also include game resource repositories(including library characters,game roles,game backgrounds,game props,sound effects,arithmetic of running games,etc.).It covers the forms of literature,art,music and other types of works.In this regard,the academic circles and the judicial practice circles also revolve around the possibility of the network game as the kind of film works and assembly works.The copyright infringement case related to the live game is one of the most avant-garde cases in the current judicial practice.The main problems related to copyright theory and practice circles attention and discussion:first,the game live pictures of the nature of live pictures belong to what type of work:in addition to live pictures of running game screen,also includes game commentary,text interaction with expression of"originality",belongs to the class of film works.The operation of a large electronic games broadcast platform is the copyright owner;have the originality requirement of Red Net anchor may also become a deduction of the owner of the copyright copyright broadcast on the game screen;game player operating behavior does not have a unique contribution to the network game,live footage is not entitled to copyright.Second,online game live broadcast may infringe exclusive rights:online game live behavior is a kind of non interactive dissemination of works' behavior,and that can not be controlled by broadcasting right and information network transmission right.However,the illegal network game live acts not prohibited will be obviously unfair,shall be governed only by using the fallback provision that the work right enjoyed by other people.Third,the rational use of network live analysis:is it reasonable to live on the live platform to live the game?The author will use the "four elements" to distinguish the subject behavior under different direct seeding modes.
