Civil Law Protection Of Personal Information In Network Environment

Under the network environment,the commercial value of personal information is prominent,at the same time,the potential subject of network infringement is extensive,the means of infringement is hidden,the tort behavior is diverse,which makes the protection of personal information more difficult.At present,in our country,the special legislation of personal information has not been promulgated.There are provisions on the protection of personal information scattered in various departmental laws.The right of personal information has not been listed as a specific personal right or property right.It with portrait right,name right to be protected.The legal protection of personal information involves multiple conflicts of rights,which is the result of the cross-protection of various departmental laws.The author focuses on the protection of the civil field and discusses the legal protection of personal information under the network environment from the viewpoint of curbing infringement.The article first introduces the personal information and the right of personal information by using the concept analysis method,and then uses the questionnaire to analyze the present situation of the legal protection of personal information in our country,sorts out the existing problems of legal protection of personal information in our country,and then uses comparative analysis Law to study the legislative practice of the legal protection of personal information outside the domain,and then come to Chapter V countermeasures and suggestions to improve the legal protection of personal information in China.In the network environment,the civil law protection of personal information should be combined with the characteristics of information collection,utilization and management in the network age.The principles of personal information protection should be clarified,and norms should be set for different subjects including the juveniles.It also should improve the legal relief mechanism and establish special law enforcement and regulatory bodies.
