Research On The Legislative Change Of Marital Property System In Twentieth Century In China

With the development of the market economy in our country,social wealth tends to be diversified,and the types of husband and wife's property are becoming more and more diverse.Correspondingly,the property relationship between husband and wife has become more and more complicated.There are more and more contradictions and disputes between the husband and the wife on the property.Therefore,the legislation on the property system of the husband and wife is also highly concerned in the society.Whether in the family or social life,the key role of the property system of the husband and wife is increasingly prominent.This article reviews the process of establishing,perfecting,developing,and changing the matrimonial property system during the twentieth century in China.It analyzes the basic process and phase characteristics of the legislative change of the matrimonial property system in accordance with relevant legislation,and seeks to summarize the development laws for the current couple.The perfection of the property system legislation provides reference.The main body of the thesis is divided into three parts:the first is the legislative process,legislative contents and legislative features of the marital property system from the period of the late Qing Dynasty to the Republic of China(1911-1930);the second is the matrimonial property system during the revolutionary base period(1927-1949).The legislative process,legislative content and legislative features;the third is the legislative process,legislative content and legislative features of the matrimonial property system from the establishment of New China to the end of the 20th-century.Through a comprehensive analysis of the legislation on the matrimonial property system in each period,the trajectory of the legislation of the matrimonial property system at each stage was compared and analyzed,and the background,guiding principles and influence of the legislation on the matrimonial property system in each era were combed.Finally,it summarizes the changing law of the matrimonial property legislation in the 20th century,and puts forward its own suggestions for the consummation of the conjugal property system in the future.
