Nowadays,artificial intelligence and big data have occupied the forefront of the development of the times.“Internet+” has also become an indispensable technology in people's daily lives.The civil execution procedure is whether the rights of the right holder can be finally realized,whether the substantive law can be truly implemented and whether the mandatory performance of the law can be truly embodied.In the "Internet +" era,more and more things can be solved through the network."Final" of the judicial auction,also through the use of "Internet +" mode presents a new form-network judicial auction.Compared with the traditional judicial auction,the network judicial auction highlights the strong economic and social benefits.The network Judicature Auction has the information dissemination widespread,open transparent,petty cash and other advantages,can maximize the auction turnover and premium rate,so as to effectively curb the appearance of the surrounding standard,serial label and other malicious auction,the greatest extent to achieve the interests of the parties,and to further improve the implementation of quality and efficiency,timely realization of the interests of the successful party,It is important to promote a basic solution to the "difficult implementation" situation.It is also based on a network of judicial auctions have so many advantages,home buyers or investors are willing to come to the judicial auction market "leackage gold."By combing the historical evolution of the network judicial auction in China,this paper grasps the development process of the network judicial auction,and then leads to the value of the network judicial auction in China.Secondly,it introduces the legal situation and the judicial status of the network judicial auction in our country,and introduces the four typical models in China: the property rights exchange model,the auction center model of public resources and the people's law.The hospital asset network model and the Taobao network model.Through the analysis of the main features and advantages and disadvantages of the above four models,the following problems are found in the existing mode of the network judicial auction in China: the imperfect investigation procedure before the auction,the imperfect supervision mechanism in various aspects,the vulnerable network attack and the blurry responsibility for the defect guarantee.Finally,I put forward a series of suggestions for the above problems in the process of online judicial auction,in order to improve our network judicial auction.
